weAltura Terms of Service

Events and experiences listed on weAltura are organized by event hosts, not us. We are a third party service providing the technology for managing events and experiences, we are not responsible or liable:

• for event cancellations by the host;

• for any content or activities related to the event;

• for the accuracy of the event information provided by the host, including the time and connection details.

If you have an issue or question regarding any of the above, you should contact the event host. Hosts have full control over their events, and it is their responsibility to inform you of any relevant terms or policies that apply to your use of the Service outside of these Terms, as well as to respond to and resolve any disputes that you may have regarding their events.

Responsibility in the Execution of Outdoor Experiences

weAltura does not participate in the practical execution of outdoor activities and is not involved in the operational management of experiences booked through the Platform.

Each activity is entirely carried out by the professional hosts, who:

• operate with full technical and organizational autonomy

• are solely responsible for the safety of participants

• choose routes and itineraries

• evaluate environmental conditions

• assess the suitability and preparedness of participants

Because weAltura does not organize or conduct activities directly, it:

• is not liable for accidents, injuries, or damage to persons or property occurring during the activity

• is not liable for delays, cancellations or changes to the activity due to decisions made by the host or environmental factors

• is not liable for the User’s failure to inform the Guide of relevant physical conditions or specific needs

• does not guarantee that a given activity is suitable for the User’s technical or physical level—that evaluation is the exclusive responsibility of the professional host.

Civil and professional liability for the execution of the activity lies entirely with the Host, who acts as an independent contractor.

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”).

Subject to these Terms, you may share political opinions or other Content as permitted by applicable law. You agree that you are solely responsible for any content you post on the Service.

You further agree that unless we agree otherwise in writing, you grant us and applicable hosts an unrestricted, worldwide, irrevocable, non-exclusive and royalty-free right to use, adapt, modify, publish, translate, distribute and display any Content you post on the Service, in any form or media.

Our Service may contain links to third-party web sites or services that are not owned or controlled by weAltura.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

By using the Service, you agree to be bound by the YouTube Terms of Service.

You must not use the Service in any unlawful or fraudulent manner, or in a way that could damage or compromise our systems or security. And you must not access the Service by any means other than our publicly supported interfaces.

If you import people’s data into weAltura (names / emails), you must have their explicit consent to import them and send them emails. Violation of this policy will result in suspension of your account.

Bookings made through the Platform are binding once confirmed.

• Payments are processed via Stripe, which acts as an independent controller of payment data.

• weAltura does not access or store Users’ card details.

• A booking is considered confirmed only after successful payment.

Refund and cancellation policies may be specified for each individual experience or communicated directly by the Host. Where no specific policy is visible, Users should contact the Guide or weAltura for clarification before booking.

To the maximum extent permitted by applicable law, weAltura shall not be liable for:

• indirect, consequential, incidental or unforeseeable damages

• service interruptions due to technical issues, maintenance or force majeure events

• the content, behavior or performance of Guides

• any events, incidents or issues occurring during the outdoor activity booked via the Platform

The User agrees to hold weAltura harmless from any claims, damages, liabilities or costs arising from:

• violation of these Terms

• conduct during activities

• misuse of the Platform

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

All content and other materials available on our websites and presented as part of the Service, including, without limitation, trademarks, service marks, trade names, images, audio, text, software, and the “look and feel” of https://wealtura.com and its associated lower-level webpages (collectively, “Site Content”) are protected by copyright, trademark, and other intellectual property laws. Such Site Content includes weALTURA™ and related stylized “weAltura” designs, which are common law trademarks of weAltura. You may not reproduce, republish, distribute, display, perform, transmit, sell, or otherwise use any Site Content without our express written permission, except when such actions occur in connection with bona fide uses of the Service through our publicly supported interfaces. In this regard, users are prohibited from downloading, republication, retransmission, reproduction, or other use of any image (and other similar content) as a stand-alone file. Furthermore, Site Content may not be used in any manner that is likely to cause confusion among consumers.

We welcome feedback on our Service. However, you agree that any ideas, suggestions, drawings, graphics, innovations, concepts, recommendations, or similar materials (“Submissions”) you send us are not confidential. You hereby assign such Submissions to us without compensation (or the expectation of compensation), and agree that we may disclose, reproduce, republish, modify, distribute, display, perform, transmit, sell, or otherwise use your Submissions for commercial or non-commercial purposes with no compensation to you. For any Submissions that cannot be legally assigned to us, you hereby grant us an unrestricted, perpetual, royalty-free, irrevocable, fully paid-up, and worldwide license to reproduce, republish, modify, distribute, display, perform, transmit, sell, or otherwise use your Submissions for commercial or non-commercial purposes with no compensation to you.

These Terms are governed by Italian law.

For any dispute arising from the interpretation or execution of these Terms, the exclusive jurisdiction shall be the Court of Milan, Italy.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

weAltura reserves the right to modify these Terms at any time.

Any changes will be published on the Site and will take effect from the date indicated as “Last updated”. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.

By using the Platform, the User acknowledges and declares that they have read and understood the Privacy Policy available on the Site, which forms an integral part of these Terms.
