These Terms of Service (“Terms”) govern access to and use of the weAltura platform, available at wealtura.com, and any related services (together, the “Platform”).
By accessing the website, creating an account or booking an activity, you acknowledge that you have read, understood and agree to be bound by these Terms.
weAltura is an early-stage startup that operates as a digital intermediary platform for the promotion and booking of outdoor activities, sports experiences and trips in natural environments, which are organized and conducted by independent professional guides.
Please ensure you understand the following terms, as they set out the conditions, rights and other essential information regarding your access and use of the Service.
Please note that we may change these Terms at any time at our sole discretion, in our sole discretion by posting updated versions of these Terms on our website (the “Website”) or otherwise providing notice to you. All such changes shall become effective upon the posting of the revised Terms on the Website or upon notice to you, as applicable.
1. Nature of the Service and Role of weAltura
weAltura provides a digital platform that allows users (“Users”) to discover and book outdoor activities and sports experiences conducted by independent professional guides (“Guides”).
weAltura:
• promotes and showcases activities and experiences on the Platform
• facilitates communication between Users and Guides
• manages the technical and logistical aspects related to booking
weAltura does not provide guiding or accompanying services, does not direct or supervise the on-site execution of activities and is not responsible for the actual conduct of any outdoor activity. All activities are carried out exclusively by the appointed Guide, who assumes full responsibility for the experience, including participant safety.
The Guide acts as an independent professional service provider and is solely responsible for the technical and professional execution of the activity.
2. Responsibility in the Execution of Outdoor Activities
weAltura does not participate in the practical execution of outdoor activities and is not involved in the operational management of experiences booked through the Platform.
Each activity is entirely carried out by the professional Guide, who:
• operates with full technical and organizational autonomy
• is solely responsible for the safety of participants
• chooses routes and itineraries
• evaluates environmental conditions
• assesses the suitability and preparedness of participants
Because weAltura does not organize or conduct activities directly, it:
• is not liable for accidents, injuries, or damage to persons or property occurring during the activity
• is not liable for delays, cancellations or changes to the activity due to decisions made by the Guide or environmental factors
• is not liable for the User’s failure to inform the Guide of relevant physical conditions or specific needs
• does not guarantee that a given activity is suitable for the User’s technical or physical level—that evaluation is the exclusive responsibility of the professional Guide
Civil and professional liability for the execution of the activity lies entirely with the Guide, who acts as an independent contractor.
3. User Obligations
By using the Platform and/or booking an activity, the User declares and agrees to:
• provide true, accurate and up-to-date information at the time of booking
• inform the Guide of any physical condition, limitation or issue that may affect the safety of the activity
• follow the instructions given by the Guide before and during the activity
• use any equipment provided in a correct and responsible manner
• behave diligently and prudently during the activity
The User is responsible for any damage caused to persons or property as a result of careless, negligent or inappropriate conduct.
The User also agrees not to use the Site or Platform for unlawful, fraudulent purposes or in ways that are contrary to these Terms.
4. Bookings and Payments
Bookings made through the Platform are binding once confirmed.
• Payments are processed via Stripe, which acts as an independent controller of payment data.
• weAltura does not access or store Users’ card details.
• A booking is considered confirmed only after successful payment.
Refund and cancellation policies may be specified for each individual experience or communicated directly by the Guide. Where no specific policy is visible, Users should contact the Guide or weAltura for clarification before booking.
5. Limitation of Liability
To the maximum extent permitted by applicable law, weAltura shall not be liable for:
• indirect, consequential, incidental or unforeseeable damages
• service interruptions due to technical issues, maintenance or force majeure events
• the content, behavior or performance of Guides
• any events, incidents or issues occurring during the outdoor activity booked via the Platform
The User agrees to hold weAltura harmless from any claims, damages, liabilities or costs arising from:
• violation of these Terms
• conduct during activities
• misuse of the Platform
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
6. Access to the Platform
weAltura may, at its sole discretion:
• suspend or limit access to the Site or Platform
• modify features or content
• remove activities or Guides that do not comply with its standards
Such changes do not entitle Users to compensation.
7. Intellectual Property
All content on the Platform (including trademarks, text, photos, layouts, graphics, and software) is the exclusive property of weAltura or its authorized partners and is protected by copyright and intellectual property laws.
Users may not copy, distribute, modify, reproduce, transmit, or otherwise exploit any content without prior written authorization from weAltura.
8. Privacy
By using the Platform, the User acknowledges and declares that they have read and understood the Privacy Policy available on the Site, which forms an integral part of these Terms.
9. Applicable Law and Jurisdiction
These Terms are governed by Italian law.
For any dispute arising from the interpretation or execution of these Terms, the exclusive jurisdiction shall be the Court of Treviso, Italy.
10. Changes to the Terms
weAltura reserves the right to modify these Terms at any time.
Any changes will be published on the Site and will take effect from the date indicated as “Last updated”. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.
